CONTROL

The mediator facilitates the discussion without advising or taking sides. The format can vary dependent on the circumstances (face-to-face and/or shuttle mediation) and the disputants’ wishes.

The content of the discussion is up to the disputants. All interests and concerns are recognised in mediation. Many disputants choose to bring a solicitor with them.  It is important to note that the mediator will not provide any advice of any nature.

It is essential that each party has someone present who has the authority to agree to a settlement.

Most important – unlike the court process, parties remain in control of all the outcomes.

SPEEDY

COST

Mediation: Lucent Talking charges one fee per party per day plus expenses.

Included: all support in preparation for the mediation, one mediation day & follow up support, if required. Each party bears their own legal fees & a share of the venue hire & refreshments costs. Sometimes further time needs to be spent in mediation, for which the fee is reduced by 50% plus expenses.

Other services:  Fees for facilitation, mentoring & training are determined with clients after clarity has been determined as to the tasks involved. Some of Lucent Talking’s clients agree to a retainer agreement & support is provided in a wide range of scenarios, e.g:-

Staff led consultations to improve processes to achieve better results.
